Unable to start mongo instance on Mac OS Monterrey 12.6 using homebrew

when I try to run brew services list I still see mongodb-community error 15872 root ~/Library/LaunchAgents/homebrew.mxcl.mongodb-community.plist does this file also need to be owned by ds or root ?

The plist file should be owned by your user. It seems you’ve got you system in a weird state. I am not sure how that would have happened. I don’t think that there should be anything in your home directory that is not owned by you.
